High Court set to rule on MDC 7 bail appeal Thursday

The High Court is set to deliver judgment on Thursday in the bail appeal case involving seven activists from the Movement for Democratic Change (MDC), who have been in custody since late April over allegations linked to planned demonstrations against Constitutional Amendment Bill No. 3.

The accused - Clifton Zumba, Shingirai Chitauro, John Simon, Tonderai Cephas Makuyana, Decent Dzaida, Jane Makovere and Austin Name are facing charges of incitement to commit public violence and criminal nuisance.

According to MDC spokesperson Lloyd Damba, the group was initially denied bail at the Harare Magistrates Court before their legal team, represented by Zimbabwe Lawyers for Human Rights, appealed the decision at the High Court.

"Our defence team countered that the charges are weak, the accused have fixed addresses, and pre-trial detention violates the constitutional presumption of innocence," Damba said.

The bail appeal was heard on Monday, with the State opposing their release.

The seven activists are currently being held at Chikurubi Maximum Security Prison, and the ruling on Thursday will determine whether they are released on bail or remain in custody pending trial.

Damba said a favourable ruling would see the activists released under conditions, while an unfavourable outcome would keep them in remand custody until trial.

The case has attracted political attention as it comes ahead of Parliament's expected vote on Constitutional Amendment Bill No. 3, which has sparked debate within opposition and civil society circles.

Observers say the High Court's decision could also influence how bail applications are handled in politically sensitive cases going forward, particularly under the current legal and political environment in Zimbabwe.

The court has not yet confirmed whether the ruling will be delivered in open court or communicated to the parties in writing.
