A 28-year-old man from Masvingo has been fined $100 or 30 days in prison for striking a fellow reveller until he lost his teeth for not understanding IsiNdebele.
Ngodho Madzingo (24) of Village 27 Mushandike under Chief Charumbira pleaded not guilty to a charge of assault when he appeared before magistrate Mr Oliver Mudzongachiso yesterday.
He was, however, convicted due to overwhelming evidence and fined $100 or 30 days in prison.
In mitigation Madzingo who was initially jointly charged with Trust Jaricha (23) of Chiredzi before the latter was discharged after plea said he did not assault Munyaradzi Chikamhi (31) but the two were fighting following a misunderstanding.
The prosecutor, Mr Tafirei Tandirai, said on 21 September at about 4am and at Manyama Business Centre, Madzingo and Jaricha approached Chikamhi.
When they got to him, they started speaking in IsiNdebele, which Chikamhi does not understand.
The court was told that Madzingo who looked drunk started asking Chikamhi who was sitting on the pavement why he was not responding when they were talking to him.
Chikamhi turned his head to look at the people who were speaking in a language he did not understand.
When he faced the pair, he told them that he did not understand IsiNdebele and that irritated the two.
The two then started assaulting Chikamhi with fists several times on the mouth and kicked him all over the body.
The court was told that Madzingo kicked Chikamhi twice on his private parts. Chikamhi lost four front teeth as a result of the assault.
At realising that Chikamhi was seriously injured, Madzingo tried to atone him down saying he would compensate him.
He also promised him that he would foot all medical expenses.
A report was made to the police the following morning leading to Madzingo's arrest.
A medical report was produced in court as evidence.
