The bail application matter for jazz musician Dudu Manhenga has been postponed to Wednesday after the state failed to file its response in time.
Manhenga's second attempt to secure release on bail pending appeal failed after the state represented by Edmore Nyazamba told Justice Felistus Chatukuta that he failed to respond to submissions by the defence on time as he had attended a funeral.
Justice Chatukuta then postponed the matter to Wednesday morning where she will entertain arguments by the two parties after indicating she also wants to go through the record of proceedings before making a determination.
The jazz song bird is serving an effective 18 months for a culpable homicide charge committed in 2010.
Manhenga was found guilty as charged by Harare Magistrate Blessing Murwisi who handed her a 2-year term of imprisonment before suspending 6 months on condition of good behaviour in the next five years.
Manhenga's initial bail application against the 18 month prison term was dismissed by the magistrate Ms Murwisi as she ruled that Manhenga committed a very serious offence, adding that she was likely to abscond if granted bail and there were no prospects of success on appeal.
