5 security guards charged for killing suspected thief

Five private security guards appeared at the Harare Magistrates' Court yesterday facing culpable homicide charges after they allegedly fatally assaulted a suspected thief whom they caught red-handed trying to break into a house.

The accused - Samuel Desire Madhudhu (22), Jonathan Mugadza (28), Albert Kuona (42), Trymore Topo (26) and Chenjerai Chikafu (30) – appeared on summons before regional magistrate Lucy Mungwari, who postponed the trial to January 24 next year.

Allegations are that on November 19, 2014, at around 2am, Madhudhu, Mugadza, Topo and Kuona were on duty in the Hayhill area, Glen Lorne, when they saw the now-deceased Muneinazvo Mambara and his accomplice approaching one of the houses they were guarding.

It is alleged Kuona and Topo approached the intruders who were now trying to force open the window. On noticing the two, Mambara and his friend fled the scene.

The State alleges Kuona and Topo shouted for help, alerting Madhudhu and Mugadza. It is alleged Topo and Kuona apprehended Mambara.

The four took Mambara to a base where they fatally assaulted him after tying together his hands with an electric cord.

Police took the now-deceased to Parirenyatwa Group of Hospitals for medical examination where he later succumbed to injuries on the same day.

The five were subsequently arrested for the offence.
