Bail revoked for cop accused of fatal assault

A Ruwa-based police officer accused of fatally assaulting a suspect in custody has had his bail revoked after failing to appear for trial at the High Court.

The accused, Prince Ndavambi (39), of Waterfalls, Harare, had been released on US$400 bail pending trial. The State was prepared to proceed with the case and had lined up five witnesses to testify against him.

Following his failure to attend court proceedings, the High Court revoked his bail and issued a warrant for his arrest.

According to court papers, the allegations stem from an incident that occurred on April 27 last year when Ndavambi and fellow police officers, Constables Changorera and Mundofa, arrested a man in Damofalls Phase 1 on allegations of assault and theft.

Ndavambi was reportedly the investigating officer in the matter.

The court heard that after the suspect had been detained in police holding cells, Ndavambi allegedly booked him out of custody and took him to a nearby room for questioning.

During the interrogation, Ndavambi is accused of repeatedly assaulting the suspect with a hoe handle.

Prosecutors allege that the suspect was later returned to the cells in a weakened state and was struggling to walk and speak.

His condition reportedly deteriorated, prompting his transfer to Ruwa Rehabilitation Centre for medical attention before he was referred to Parirenyatwa Group of Hospitals.

The suspect later died while receiving treatment.

His body was subsequently taken to a mortuary for a post-mortem examination.

The first post-mortem, conducted by Dr Gullien, recommended further toxicology and histology tests. A second examination by Dr Javangwe supported the need for the additional tests.

According to court records, Dr Javangwe ultimately concluded that the cause of death was hypovolaemic shock and intramuscular haemorrhage resulting from blunt force trauma.

Ndavambi remains wanted by authorities following the issuance of the warrant of arrest, while the State continues with efforts to bring him before the court to answer to the charges.
