Chivayo's death sparks high-stakes legal showdown over US$25 million fortune

The sudden death of flamboyant Zimbabwean businessman Wicknell Chivayo has thrown his multi-million-dollar estate into legal uncertainty, with a Supreme Court appeal in his US$25 million matrimonial and asset-distribution dispute with his ex-wife, Sonja Madzikanda, now on hold.

The matter was removed from the court roll following Chivayo's death, according to his lawyer, Advocate Sylvester Hashiti.

"The matter was removed from the roll on account of the appellant's demise until such a time he is substituted by his executor or executrix who will represent him in court as concerns any claims against his estate," Hashiti said.

Chivayo's death means that the ongoing litigation cannot proceed in his name until an executor or executrix is appointed to represent his estate.

Under Zimbabwean estate administration procedures, the Master of the High Court will oversee the registration and administration of the estate, including the appointment of an executor.

For Madzikanda, the development does not necessarily bring her legal claims to an end. Claims arising from financial obligations and civil disputes involving a deceased person may be pursued against the estate, subject to the applicable legal process.

Sources close to the matter indicate that Madzikanda's legal team intends to submit her claims, including those relating to property division and maintenance, to the executor once an appointment has been made.

Should the claims be disputed, they may be pursued through the appropriate legal channels.

Chivayo was survived by two minor children, whose interests will also form part of the estate administration process.

The estate must first be assessed, with valid debts, liabilities, taxes and legitimate claims dealt with before the balance of the estate is distributed to beneficiaries in accordance with the applicable succession arrangements.

The interests and welfare of minor children are also subject to the protections provided under Zimbabwean law.

A key issue in the administration of Chivayo's estate will be whether he left a valid will.

If a valid will exists, the estate will generally be administered in accordance with its provisions, subject to applicable legal requirements and the rights of beneficiaries and creditors.

If he died without a valid will, the distribution of his estate will instead be governed by Zimbabwe's laws of intestate succession.

The appointment of an executor will therefore be an important next step in determining how Chivayo's assets, liabilities and outstanding legal disputes are handled.

His death has effectively shifted the dispute with Madzikanda from litigation involving Chivayo personally to a process involving his estate.

With significant assets and outstanding claims potentially involved, the administration of the estate could become a lengthy legal process, with the executor expected to identify and value assets, establish liabilities, consider creditor claims and ultimately oversee distribution in accordance with the law.
