A CHITUNGWIZA man was fined $80 for assaulting his brother-in-law after he accused him of bed-wetting during the night. Bright Nduna (29) of Unit H, Chitungwiza has up to August 31 to pay the fine.
Nduna had denied assaulting his brother-in-law Edwin Kanatsa when his trial started before magistrate Mr Lazarus Murendo. He was convicted on the basis of overwhelming evidence. Nduna is married to Kanatsa's sister. Mr Murendo fined Nduna for the offence before he slapped him with a wholly suspended two-month jail term.
The court heard that the assault took place on August 3 this year at a police station where Kanatsa had gone to report Nduna, whom he accused of destroying his sister's property. But in his defence Nduna claimed that he had an argument with his in-law for his wayward behaviour.
"Complainant paid us a visit and stayed for three months in a single room. We had an altercation after he would come home drunk and wake up during the night and urinate on my bed," said Nduna.
After the altercation, Nduna said that he asked Kanatsa to vacate his premises. However, Kanatsa refused saying that Nduna should not continue staying with his sister.
This resulted in Kanatsa reporting him for malicious damage to property. While at Chitungwiza police station in the charge office, the court heard that after reporting his case, Nduna was arrested. Irked by the allegations, Nduna jumped from where he was seated and punched Kanatsa.
After the incident, Nduna bolted out of the charge office but was arrested on August 5 at his house hiding under the bed. Ms Rumbidzai Mushonga appeared for the State.
