Convicted rapist Chief Chitsunge (83) of Buhera has applied for variation of bail at the High Court pleading illness and poverty.
High Court judge Justice Felistus Chatukuta postponed the application for variation of bail by Chief Chitsunge, born Magaya Gunguwo, after it emerged that his legal representative was unavailable.
Gunguwo is applying for variation on the basis that he cannot continue to abide by bail conditions as he is not feeling well, and no longer receives allowances, making it difficult for him to travel.
Gunguwo had been slapped with an effective 10 year jail term in March 2013 for rapping a 14 year old girl before he was granted $500 bail by Justice Joseph Musakwa on appeal.
Justice Musakwa ruled that there were prospects of success on his appeal against both sentence and conviction as the 15-year jail term was unreasonable and given that the case was tainted with various inconsistencies.
