INFORMATION and Broadcasting Services minister Jonathan Moyo is still pursuing his Electoral Court petition seeking a recount of Tsholotsho North ballots despite his appointment into President Robert Mugabe's Cabinet.
Moyo is one of the beneficiaries of the five non-constituency seats.
Moyo was beaten by MDC-T's Roselene Nkomo in the July 31 elections and has challenged the results citing a number of irregularities.
His lawyer Job Sibanda on Wednesday said the case was still on because Moyo had not indicated a desire to drop it.
"I haven't got instructions from my client (Moyo) to withdraw the matter," he said.
"As far as I am concerned, we are still pursuing it and we are waiting for a hearing date."
Nkomo's lawyer, Matshobane Ncube said if Moyo decided to withdraw the case he would have to file a notice of withdrawal at the Electoral Court.
