SARS is clearly in the business of celebrating hollow victories. This judgment relates to a condonation application I made some time back and does not speak to the issues I raised in my media briefing this past Monday, 13 October 2025. These issues have yet to be tested before our Courts.
The judge did not only dismiss my application for condonation for the late filing of my answering affidavit, but further stated the dismissal of the condonation does not bar Mr Montana from filing his answering affidavit together with a new condonation application. This is because we did not attach the answering affidavit to the condonation application. SARS and News24 will not tell South Africans about this comment by the judge.
It is ultimately up to me to decide whether or not to file a new condonation, with my answering affidavit. I'm considering this in the context of my new strategy outlined on Monday, which is totally different.
We now know that SARS acted unlawfully and in breach of the Tax Administration Act, something we did not know when we first lodged the condonation application. The current sequestration proceedings by SARS are based on illegality and will be challenged. We now have the full information to take on SARS outside of the current illegal sequestration processes.
Contrary to SARS celebration, this judgment is not a victory for SARS.
This is simply mute.
