BUSINESS executive, Anthony Mandiwanza, has been acquitted of assaulting his worker using the butt of a gun.
Mandiwanza, of Glen Lorne was yesterday set free by Harare magistrate Eric Kadye after a full trial.
Magistrate Kadye said the complainant had failed to put facts on the table.
The medical affidavit, which was produced in court was also questionable because it was outdated hence deemed not suitable to be used as evidence.
Magistrate Kadye also said the complainant alleged that he was assaulted along with his work mate but he (workmate) never reported neither testified in court.
Mandiwanza had stood in the dock accused of assaulting a security guard manning his residence using the butt of a rifle after an altercation.
The State, led by Lovemore Siamunda alleges that on November 21 last year around 4am, the complainant Edmund Mutusva was manning the accused's house along with another security guard.
The State had alleged that Mandiwanza hit the complainant using a 202 rifle butt on the left hand and ordered the two to leave the premise.
As a result, the complainant reported the case to the police and was referred to the hospital for treatment.
Magistrate Kadye, who presided over the matter, found Mandiwanza innocent.
