Tshabangu survives Parliament recall for now

Judge President Justice Mary Zimba-Dube has issued an order barring the Citizens Coalition for Change (CCC) party from recalling expelled interim secretary-general Senator Sengezo Tshabangu from Parliament until his High Court application challenging his dismissal is heard.

Senator Tshabangu sought the court's intervention to prevent his removal, citing the CCC, the Speaker of Parliament, and the President of the Senate as respondents in his legal action.

His lawyers approached the court for case management in two matters: an interdict in the case of Sen Tshabangu v CCC and Others and a declarator in the case of Sen Tshabangu v Sesel Zvidzai and Others.

In the interdict matter, Justice Zimba-Dube recorded an undertaking from the CCC that it would not take any steps to recall Senator Tshabangu or undermine case number HCH 830/25, which challenges his expulsion. The Speaker of Parliament's legal representatives also acknowledged the court's directive.

In the declarator case, the respondents are required to submit their opposing papers by Tuesday, 4 March 2025, while the applicants must file their answering affidavit and heads of argument by Monday, 10 March 2025. The matter is scheduled for a hearing on Thursday, 13 March 2025.

Senator Tshabangu has named Mr Sesel Zvidzai, Ms Concillia Chinanzvavana, Mr Gilbert Kadogora, Mr Shepherd Mushonga, and the CCC as respondents in the declarator matter. These individuals formed the disciplinary committee that expelled him from the party.

This interim order ensures that Senator Tshabangu remains in Parliament pending the resolution of his legal dispute. The case has drawn significant attention as it could impact CCC's internal dynamics and parliamentary representation.
