Schools across the country have been warned against expelling learners from school due to non-payment of fees, with indications that this is a violation of their rights to education.

Schools opened for the second term on Tuesday and some learning institutions expelled learners because they have not paid school fees.

National Association of Schools Development and Committees (Nasdac) Chairperson Max Mkandla said schools must not expel learners.

"Some schools were locking the gates to prevent the pupils from entering the premises on account of failure to pay fees. We are saying this is a violation of children or learners' right to education," Mkandla said.

"The children have no contract with the school, but their parents and guardians. The children are going to school to get education so that they are useful to the nation in the future. Schools must respect that because disadvantage at this stage will not only affect their future but the whole nation."
