Dispute over Spitzkop property continues in court

The legal battle over a $29 million property in Spitzkop, Harare, continued on Tuesday at the Harare Magistrates Court, with Thomas Masango alleging that his brother-in-law, Tendai Jemwa, fraudulently removed him from ownership of the land.

During cross-examination, Masango told the court that he had contributed to the property's purchase but was not informed when it was sold. The dispute stems from a business partnership between Masango and Jemwa that soured over the years.

The State, represented by Ephraim Zinyandu, stated that in 2007 Masango and Jemwa entered verbal business agreements and jointly acquired several properties, including 58 Spitzkop, Snake Park, Harare, from a seller named Zinto for $29 million. Zinto had purchased the land from Jeremiah but the title deed (number 10146/89) had not yet been transferred into his name at the time of sale.

According to the prosecution, both parties intended for the property to be registered under Ten Jem Consultants (Pvt) Ltd, a company owned by Jemwa, with Masango to receive a 50% shareholding and directorship as part of their agreement. However, in 2012, Jemwa allegedly defrauded Masango by secretly retrieving the transfer documents from their lawyer, before the property was officially registered or the 50/50 shareholding finalized.

The trial has been adjourned to 4 September 2025 for continuation.
