State moves to seize ex-council boss's assets

JAILED former Mutoko Rural District Council chief executive Peter Sigauke is facing the loss of three low-density residential stands and eight vehicles after the Prosecutor-General applied to the High Court for their forfeiture, arguing that the assets were acquired using tainted proceeds.

Sigauke and former Mutoko Rural District Council town planner Enock Mukwekwe were each sentenced to two years in prison in June 2022 after they were convicted of criminal abuse of office.

The pair were found guilty of illegally selling residential stands carved out of the Chinzanga Beer Hall yard and part of a bus terminus in Murehwa, pocketing US$12 000 from the transactions.

A Murehwa magistrate also ordered the two to restitute the US$12 000.

Following Sigauke's conviction, the Prosecutor-General initiated civil forfeiture proceedings, seeking to recover assets allegedly acquired through the proceeds of the offence.

The High Court has granted an interim order barring Sigauke from dealing in, disposing of, alienating or otherwise encumbering the properties while the application for a civil forfeiture order is pending.

The assets targeted by the State include Stand No. 2921 Low Density, Plot 35 Tabudirira and Plot 65 Jerenje in Mutoko.

The Prosecutor-General is also seeking the forfeiture of eight vehicles, namely a Nissan Elgrand (ACY 8666), Toyota Noah (ADJ 7828), Toyota Hiace (ADZ 1752), Honda Fit (AEO 5416), Honda Fit (AEY 7327), Toyota Hiace (AGB 1211), Toyota Hilux (AGA 9432) and Toyota Hiace (AGL 0937).

In a separate matter, Mutoko businessman Givemore Dhliwayo is also facing civil forfeiture proceedings after the State alleged that his business premises, residential stands and vehicles were acquired using tainted proceeds.

The Prosecutor-General has similarly secured an interim High Court order preventing Dhliwayo from selling, transferring or otherwise dealing with the properties until the civil forfeiture application has been determined.

Among the assets the State is seeking to confiscate are commercial premises at numbers 4015C, 5752 and 5748 at Shaz Shopping Centre in Mutoko, residential stands number 4466 Medium Density and 4455B Medium Density, as well as commercial premises at number 4017 Nyabote Township.

The application also seeks the forfeiture of two Hino Ranger trucks, registration numbers AGD 5506 and AGN 0087.

The civil forfeiture applications are yet to be determined by the High Court.
