Karoi businessman and farmer, Themba Mliswa, has been released by the High Court after being granted bail.
Mliswa is facing charges of public violence.
He paid one hundred dollars bail.
Charges against him arose after he allegedly mobilised people to assault Hurungwe legislator, Sarah Mahoka.
In his ruling, High Court Judge, Justice Joseph Musakwa said the State did not give sufficient evidence linking Mliswa to the commission of the offence.
Justice Musakwa noted that the investigating officer in the case did not visit the scene of the alleged crime to ascertain if the community will be affected by Mliswa's release.
The State is alleging that Mliswa mobilised his seven co-accused persons and others who are still on the run to assault Mahoka in Zvipani area, where she was conducting a Zanu-PF rally.
Mahoka is alleged to have sustained serious injuries after the attack.
Mliswa and his accomplices were denied bail by a Karoi magistrate before successfully seeking another bail application at the High Court.
