Taxi driver wilfully infects girl with HIV

AN HIV-positive Rusape taxi driver has been arrested for deliberately infecting a 15-year-old girl with the virus following a series of unprotected sex sessions.
Arthur Rusinga (33) of Mabvazuva was arraigned before a Rusape magistrate charged with deliberately infecting the complainant with HIV and AIDS.
Rusinga is also facing an alternative charge of having sex with an underage girl.
He is being represented by Mr Leonard Chigadza of Chigadza and Associates.
Rusinga was not asked to plead when he appeared before Mr Shingi Mutiro. He is being accused of violating section 79 (1) (a)(b) of the Criminal Law (Codification and Reform) Act which makes the engagement in unprotected sex when one is fully aware that he/she is living with HIV and AIDS a punishable criminal offence.
Public prosecutor Mr James Wirima told the court that Rusinga, who is married, has been having unprotected sex with the Form 3 girl for the past six months.
"Arthur Rusinga and the complainant are lovers and they stay at the same house.
"On a date unknown to the prosecutor but during the period from July 1, 2014 and December 25, 2014 the accused person would take advantage of his wife's absence to have sexual intercourse with the juvenile.
"Rusinga would take the young girl out and then have unprotected sexual intercourse with her after she had consented.
The matter came to light on January 2 2015 when Rusinga's wife confronted him about his affair with the young girl.
The complainant's mother then learnt about the affair and confronted her daughter and she revealed her sexual relationship with the accused person.
She then reported the matter to police and the complainant was referred to hospital for medical examination, which revealed that she was HIV positive".
