Man fights to recover $78,000 from police, Chombo, Chihuri

The High Court has ordered a Mutare based businessman, Tendai Blessing Mangwiro to cite Home Affairs Minister, Ignatius Chombo and Police Commissioner General Augustine Chihuri in their personal capacity before the court could hear the contempt of court application lodged by the applicant.

Mangwiro is seeking to recover $78 000 confiscated by the Zimbabwe Republic Police (ZRP) during alleged theft investigations in 2008.

Mangwiro won a court order after his acquittal over the theft charges in 2012 and the High Court ordered the police to reimburse him his US$78 000 which had been confiscated by the police as an exhibit plus interest at the prescribed rate.

The police however did not reimburse him his money, prompting him to file the contempt of court charges.

Mangwiro's lawyer, Edmore Tendai Muhlekiwa had filed the application citing Chombo and Chihuri's offices but High Court judge, Garainesu Mawadze asked him to cite the two officials in their names.

Mangwiro also cited Officer-in-Charge CID Suspects Harare Central Police Station and Detective Inspector Mukambi as respondents.

Justice Mawadze removed the matter from the roll for Muhlekiwa to attend to the defects.
