Woman (19) fabricates rape charges against boyfriend

A 19-YEAR-OLD Inyathi woman stunned a packed courtroom when she swore before the magistrate that she fabricated rape charges against her boyfriend as a way of "fixing" his family after she was assaulted by her lover's brother who was against the affair.
The alleged liar, Yvonne Ngwenya (24), of Village 1 Maqaqeni area's confession to liberate her boyfriend, Jeffrey Ngwenya (24), came after the latter had languished in remand prison for almost five months waiting for the court to set a trial date for the alleged rape charge.
Yvonne's startling confession was contained in an affidavit which she surrendered to Bulawayo magistrate Mr Takundwa Witness Mtetwa while withdrawing the rape charges against her boyfriend.
"I knew the accused as my boyfriend and I am no longer interested that the accused be charged of rape since I was in love with him and whatever we did I had consented to it.
"I filed a report to the police due to the fact that our relationship was discovered by the accused's brother and after discovering it he severely assaulted me. I felt offended by his actions and I decided to allege that I was raped by the accused so as to fix his family because of his brother's actions," read part of the affidavit.
Following the confession the matter was withdrawn before plea and Jeffreys freedom from the prison confines came two days before the country also celebrated its 33rd Independence Anniversary.
Allegations against Jeffrey who was employed as a nurse aide at Nkayi District Hospital were that sometime last year in the month of July and during the night he went to his girlfriend's homestead.
It was alleged that upon arrival, he forcibly gained entry into the bedroom hut in which Yvonne was sleeping and had sex with her but without her consent.
The court heard that the matter came to light on 21 September after Jeffrey was caught by his brother sleeping in Yvonne's bedroom hut.
The busting came after the brother who was against the affair received a tip off from some neighbours.
The accused's brother who was once married to Yvonne's mother and appeared to have been jealous of the affair severely assaulted the latter stating that she should stop dating his younger brother.
The battered Yvonne as a way of "fixing" her boyfriend's family went and reported the matter to the police stating that she was raped by her boyfriend leading to his arrest.
