A BULAWAYO woman fabricated indecent assault charges against her step-son in a bid to have him incarcerated so that she could take over her late husband's estate.
In scenes reminiscent of the Kardashians when they filed a lawsuit against their ex-stepmom purely as a storyline for their popular E reality show - "The Kardshians" - Sehliselo Silempa of Sizinda Township falsley reported that her step-son Taurai Tatayi, 26, had indecently assaulted his 11-year-old nephew and 12-year-old niece on separate occasions.
This was heard at the West Commonage Court when magistrate Tancy Dube found Tatayi not guilty and acquitted him of two counts of indecent assault.
"I give the accused person benefit of doubt on both cases. I believe the accused is being fixed by his stepmother and relatives and I therefore find him not guilty and acquit him on both counts," said Dube while passing sentence much to the relief of Tatayi who was almost shedding tears in the dock.
It was the State case that at a date unknown to the prosecutor but in the month of December last year, Tatayi who is staying with his stepmother following the death of his father, arrived home from a beer drink and found his 11-year-old nephew asleep in the spare room which they were sharing at around 10PM. Tatayi was then accused of forcing the minor to lie facing upwards. After which he got on top of him and ej*culated between his thighs.
On another framed charge and in the month of December last year, Tatayi was accused of f*ndling the breasts of his 12-year-old niece while she slept in her room around 9PM.
It was said that again while coming from the beerhall, he found her asleep and approached her before f*ndling her breasts. The niece woke up, switched on the lights and informed her aunt, Silempa, about the issue. Silempa went and made a report to the police leading to Tatayi's arrest.
In an interview outside the court, Tatayi said he was now afraid of going back home after his acquittal.
"I fear for my life. How am I going to stay with them? This is the only home my late father left for us. This really hurts because I spent 21 days behind bars for a crime I did not commit," he said. Charity Nyathi prosecuted.
