Highlanders Football Club treasurer Nkani Khoza has filed a High Court chamber application seeking to reverse and correct a divorce judgment issued over a year ago, escalating a long-running legal dispute with his estranged wife, Virginia Khoza.
The application, filed under case number HCBC 1473/25 on December 10, 2025, through lawyers Dube-Banda, Nzarayapenga and Partners, seeks a correction to the operative part of the original divorce order under Rule 29(1)(b) of the High Court Rules, 2023, as well as condonation for the late filing. Mrs Khoza was served with the papers on Monday.
The original contested divorce, heard under case number HC 321/21, was presided over by High Court Judge Bongani Ndlovu, with judgment handed down on November 29, 2024, referenced as HB 169/24. Subsequent litigation arose when Mrs Khoza sought to interdict Mr Khoza from resisting the retrieval of cattle she believed were awarded to her under the divorce settlement.
Justice Ndlovu initially ruled in favor of Mrs Khoza, prompting Mr Khoza to appeal to the Supreme Court under case number SCB 117/25. The appeal, heard on November 17, 2025, before Justices Antonia Guvava, Nicholas Mathonsi, and Joseph Musakwa, succeeded in part. The Supreme Court set aside paragraph one of the lower court's judgment and ordered that Mrs Khoza be allowed to retrieve one-third of the available cattle in compliance with HB 169/24, without awarding costs.
In the current application, Mr Khoza is requesting that the High Court explicitly correct HB 169/24 to award him four herds of cattle, representing one-third of the total twelve herds, and to direct that Mrs Khoza make arrangements to retrieve them within 30 days from his homestead or wherever the cattle are located.
Mrs Khoza has been granted 10 days to file a notice of opposition with the Registrar of the High Court in Bulawayo. The case is set to further clarify ownership and retrieval rights of the livestock, marking another chapter in the protracted divorce proceedings.
