Man fails to pay sex worker $5, jailed 10yrs for rape

A 20-YEAR-OLD Hwange man Hillary Moyo will spend the next 10 years in jail for raping a self-confessed prostitute.
Moyo failed to pay a mere $5 for the hookers services.
He was handed 13-year jail term for rape but three years were suspended for five years on condition of good behaviour by Hwange regional magistrate Dambudzo Malunga.
Moyo had also been charged with theft, but the court found him not guilty and acquitted him of the charge.
In his defence, Moyo had told the court the woman had consented to sex and was just fabricating the charges because he had failed to pay her $5 after the sexual encounter.
But, during the hearing, the woman, who confessed to being a prostitute, said although she was too drunk after imbibing cane spirit, she never consented to sexe.
Moyo had also told the court he committed the offence under the influence of alcohol and did not know what he was doing, but the magistrate quipped: "But you enjoyed sex?" and he replied: "Yes."
Prosecutor Bheki Tshabalala, told the court that on November 2 this year, Moyo was drinking beer with the woman and her friend Faustina Tshuma, when the victim decided to go and sleep in a broken horse truck, as she was too drunk.
Moyo later went to where the woman was sleeping and raped her.
The woman only discovered she had been raped when she woke up in the morning and asked Moyo who she had slept with and he confessed he had been intimate with her.
The woman also claimed Moyo stole her smartphone worth $70.
