Magistrate recuses herself from Madzibaba Veshanduko case

Harare provincial magistrate Ruth Moyo has recused herself from presiding over political activist Godfrey Karembera's bail application on changed circumstances following an application by the accused alleging bias.
Karembera, popularly known as Madzibaba Veshanduko, had applied for Ms Moyo's recusal, arguing that she could not impartially determine his matter. The magistrate granted the application, paving the way for the case to be reassigned.
The bail application will now be heard before Magistrate Tapiwa Kuhudzai on February 13.
Karembera is facing charges of incitement to commit public violence.
According to the State, the alleged offence relates to a planned march scheduled for October 17, 2025, at Robert Gabriel Mugabe Square and Africa Unity Square in Harare.
Court papers allege that police received information that Karembera was distributing fliers from a silver Toyota Aqua. The vehicle was reportedly tracked to Patrenda Way in Glen View 3, Harare, where it was intercepted.
Prosecutors allege that approximately 7 200 flyers were recovered from the vehicle and seized as exhibits.
"Accused and his other two accomplices escaped from the scene of crime, leaving behind one of his accomplices, Malvern Mavhere, who is already on remand, and he was subsequently arrested," the State alleges.
The prosecution further claims that on October 17, 2025, Karembera recorded a video allegedly inciting members of the public to attend a protest at Africa Unity Square in Harare. The video was allegedly shared across several WhatsApp groups and on Facebook.
The matter is expected to proceed before the new presiding magistrate later this week.
