The Chief Justice Godfrey Chidyausiku has been irked by the alarming figure of inactive files totaling to 46 889 at the High Court which he indicated that they comprise summons and applications which have not been served to respondents.
Officially opening the 2016 first term of the legal year Chidyausiku said a report produced by the Chief Registrar indicates that there are 46889 inactive files that clog the high Court in Harare Civil registry.
"These comprise of summons and applications filed for ten year period between 2002 and 2012. If one were to add to this figure, the dormant cases filed after that date the total number would be well above 650 000," he said.
He said of the mentioned figure more than 20 000 are idle summons and applications which were never served upon the defendants.
Chidyausiku said from the statistics presented it is evident that the actual backlog have been inflated beyond recognition by the inclusion of dormant files in the backlog statistic.
