Woman takes ex-hubby to court for infecting her with HIV

A 21-YEAR-OLD woman from Victoria Falls, who claims that her boyfriend infected her with HIV, has started legal proceedings to sue him for breaking his promise to marry her. The man has successfully applied for a protection order against her.

Rumbidzai Kwindima and her boyfriend Nigel Moyo, who works at Liquid Telecoms, had an affair in 2012 and broke up recently.

Moyo claimed in court that when he told her he was ending the relationship, Kwindima went haywire and started stalking and threatening him, prompting him to approach the court for a protection order.

He said at some point she allegedly followed him to Elephant Hills Hotel where he was staying and assaulted him before threatening to smash his car.

"We broke up on February 20, 2014 and she has been stalking me saying I should take her back because I infected her. She manhandled me and threatened to smash my car's windows on March 11. I had to go to hospital for treatment after the assault," said Moyo, who denies infecting her.

Victoria Falls resident magistrate Sharon Rosemani granted the protection order, telling Kwindima not to visit Moyo at his place of residence or workplace uninvited.

An emotional Kwindima sobbed in court as she accused Moyo of being heartless and destroying her future.

"You have spoiled my life and here you are getting a peace order against me. May God bless you wherever you go but I swear I am not done with you," she said.

Soon after the court hearing, Kwindima went to the police to report Moyo for breaking a promise to marry her and deliberately infecting her with HIV.

Moyo had not been arrested by the time of going to press although police had started investigations. In court, the couple blamed each other for contracting sexually transmitted diseases sometime last year.

Kwindima claims her boyfriend had been secretly taking anti-retroviral drugs while Moyo alleged she was only trying to fix him so that he loses his job.

"When I went to test and discovered that I was positive, he begged me not tell my family promising to marry me but now he wants to dump me. I don't understand why he said we should break up because he promised to stick by me," she said.

In response Moyo said: "I am worried about losing my job and my reputation because she is going around telling people about her claims. When I was in Harare I received numerous anonymous calls telling me that I was dating a prostitute."

The magistrate counselled the couple urging them to stop fighting and find a better way of reaching an understanding.
