Teenager in court for sodomising younger brother at knifepoint

A Bulawayo teenager has been arraigned for allegedly sodomising his younger brother aged nine twice at knife point. The boy (15) who is doing Form Three was remanded out of custody after his lawyer Mr Matshobana Ncube from Phulu Ncube Legal Practitioners said probation officers were failing to access him. He is facing two counts of aggravated indecent assault.
Regional magistrate Mr Mark Dzira remanded him out of custody to the care of his uncle to August 22 for trial. "My client is a juvenile who has been in custody since May this year and probation officers haven't compiled a report on him. We pray that the court remands him out of custody so that at least we can process the report. He's planning to plead guilty to the allegations and will not abscond," said Mr Ncube.
Prosecuting Mr Tinashe Dzipe alleges that the boy called his brother, a Grade Four pupil to their bedroom. "When he entered the room, he produced a knife which he used to threaten his brother in case he made noise. He then ordered him to undress and forced him to have anal sex once," said Dzipe.
"On a date unknown to the prosecutor during the month of April this year, the boy went back home from visiting their aunt in Pumula South. His older brother called him to the bedroom and sodomised him once threatening him with a knife he was holding."
The court heard that the matter came to light when the younger boy refused to leave his aunt's house in Pumula saying he didn't want to be subjected to sexual abuse at home by his brother.
The boy was taken for a medical examination and a report was produced as an exhibit.
