Mining firm sued for over $10 200 owed for hiring compressors

Impact Mining (PVT) LTD has been dragged to court over a debt of $10 250 which it owes a compressor owner Mongameli Sibanda after hiring his compressor for its mining activities.

Sibanda filed summons at the Bulawayo High Court on November 7 demanding the payment of the outstanding amount.

"The plaintiff has instituted proceedings against defendant for the payment of $10 250 being compressor hiring charges accumulated and not paid by the defendant since the dater of hiring," he said in his summons.

He submitted that he demanded $400 being service charges he paid to service his compressor and $200 being service charges he paid to service a jack hammer.

The mining firm was given up to ten days to have responded to the lawsuit.

In his declaration he said he entered into a deal with the company sometime in February 15 2016 for the company to hire a set of compressor and its components, a jack hammer and a pipe. They also agreed on an $80 per day charge in which thereafter the company took the equipment to its premises for use.

Sibanda said the company used the equipment for more than four months without paying until it accumulated a debt of $10 250 which is still outstanding.

 He said during the company use of his equipment he is the one who serviced the machines and paid the costs.

He said despite demand for the total sum payment, the mining firm has neglected, refused or failed to pay.
