Cop assailant remanded in custody

A 29-year-old Mutare man has been remanded in custody after appearing in court on charges of allegedly assaulting a police officer during an operation targeting illegal public transport operators.
Brenton Tsakatsa, of House Number 1285, Chikanga 1, Mutare, appeared before Mutare provincial magistrate Anne Ndiraya last Friday charged with assaulting or resisting a police officer in the execution of his duties, in contravention of Section 176 of the Criminal Law (Codification and Reform) Act.
Tsakatsa, who is represented by Passmore Gwizo of Mugadza and Chinzamba Legal Practitioners, pleaded not guilty.
The court remanded him in custody to July 13, 2026, for trial.
Prosecutor Chris Munyuku told the court that the incident occurred on June 29 at around 10:20am at Apex Service Station in Mutare during a police operation targeting illegal "mushikashika" transport operators.
According to the State, Constable Maxwell Mkumbuzi was on duty together with Constables Machazi and Mazambara enforcing "Operation No to Mushika-shika."
The prosecution alleges that Constable Mkumbuzi approached Tsakatsa, who was driving a vehicle bearing registration number AHH 5611, and informed him that he was under arrest for allegedly touting.
The State alleges that after stopping his vehicle, Tsakatsa got out and assaulted the police officer several times with open hands.
During the alleged assault, Constable Mkumbuzi reportedly dropped the baton he had been carrying.
The prosecution further alleges that Tsakatsa picked up the baton and struck the officer twice on the head and once on the left arm before returning to his vehicle.
According to the State, Tsakatsa then drove away after noticing another police officer approaching the scene.
Constable Mkumbuzi reportedly sustained injuries and was medically examined.
The prosecution indicated that a medical affidavit documenting the injuries will be produced during the trial.
The State maintains that Constable Mkumbuzi was lawfully carrying out his official duties at the time of the alleged assault.
The matter returns to court on July 13, 2026.
