Church, pastor lock horns over house

A pastor with AFM in Zimbabwe based in Zvimba is refusing to vacate church premises a year after he was relieved of his duties. The church has since approached the High Court seeking an eviction order.
A founding affidavit by AFM Harare West provincial overseer Pastor Cosam Chiangwa shows that Pastor Josiah Garamukanwa (71) was dismissed on November 21, 2013 after a disciplinary hearing.
He was accused of committing several acts of misconduct.
Pastor Garamukanwa then lodged a complaint of unfair dismissal with the Ministry of Labour in Chinhoyi.
He argues that he is entitled to remain in the church house pending finalisation of the dispute.
The case will be heard on Thursday in the High Court before Justice Mary Zimba-Dube.
In his founding affidavit, Pastor Chiangwa argues it is not a correct proposition of law that a dismissed employee should remain in the employer's premises until the finalisation of a dis- pute.
Pastor Chiangwa said they were failing to provide accommodation to a pastor who replaced Pastor Garamu- kanwa.
The new pastor is having to commute from Harare to Zvimba every Sunday.
