Mnangagwa ally's case to proceed to trial on the 12th of December

The case of Gokwe-Nembudziya member of parliament Justice Mayor Wadyajena who is being accused of insulting Zanu-PF party members, will proceed to trial on the 12th of December after the legislator withdrew his application to the Constitutional Court challenging the constitutionality of the case.

The defence said the case is distracting the legislator from executing his national duties, hence the decision to withdraw the application and proceed to trial.

Wadyajena was facing two counts of disorderly conduct allegedly for insulting Zanu-PF members Jimayi Muduvuri and  Letina Undenge, who is wife to Energy and Power Development Minister Samuel Undenge while at the party's 15thannual National People's Conference in Victoria Falls last year.

Wadyajena who is represented by Mr Givemore Muvhiringi, will stand trial on the charge against Undenge after Muduvuri who was the first complainant withdrew the charges.

In his withdrawal affidavit which was presented in court, Muduvuri said it is of national interest that as members of the revolutionary party from the same village, they are better off united and working together than dragging each other to court over trivial issues.

The defence had made a direct application to the Constitutional Court earlier this year in terms of Section 85 Sub-Section 1 of the constitution of Zimbabwe, challenging the refusal by the Victoria Falls Magistrate Ms Lindiwe Maphosa to refer the matter to the upper court.
