Lawyer calls for police boss's arrest

HARARE lawyer, Jonathan Samukange yesterday called for the arrest of Police Superintendent Nyambo Viera on accusations of tampering with evidence in a bid to allegedly protect his corrupt workmates.
Samukange made the calls as he sought to have his client, Delish Nguwaya's case referred to the Constitutional Court. Nguwaya is accusing the State of reneging on its promise to make him a State witness in an extortion case, which has sucked in top police officers and members of the Central Intelligence Organisation (CIO).
"It is submitted with greatest respect that the evidence given by all the witnesses in this application demonstrates beyond doubt and illustrates the corrupt conduct in which the case was handled by Superintendent Viera," Samukange said.
"It is clear that Viera handled the matter corruptly by deliberately removing documents, which were relevant for the prosecution of senior police officers he is protecting."
Samukange further said Viera should be charged with defeating and obstructing the course of justice.
"It is submitted that this court should order acting Prosecutor-General Ray Goba to instruct the police to investigate Viera's criminal conduct as stated," Samukange said.
Viera's woes continue to mount after National Prosecuting Authority chief law officer, Chris Mtangadura disowned his evidence that he ordered Nguwaya's arrest after the latter had offered unsolicited evidence incriminating himself and other suspects involved in extortion allegations.
Samukange told the court that CIO deputy director, Kizito Gweshe's evidence was resolute.
He said Gweshe told the court that after Viera received information linking his bosses, Chief Superintendents Nyaradzi Majachani and Sheperd Tachiona's corrupt activities, he never investigated them but concealed crucial evidence of phone calls between Nguwaya and Tachiona.
Regional magistrate, Temba Kuwanda will give his determination on August 1, while the State is expected to submit its response today.
