Land developer sued over $47 000 debt

A BULAWAYO-BASED property consultant, Aaron Radman has taken local land developer, Nuconcept Developers (Pvt) Limited, to court for failing to pay $47 668 consultancy fees for professional services provided in the acquisition of Shropshire Farm in Gweru.
Radman filed summons against the company last week, demanding payment of $47 668, citing the company and its employee Shorai Zonde as respondents.
"The plaintiff's claim is for payment of $47 668 from first and second defendants, interest at 10% per annum from August 1, 2018 to date of full payment and costs of suit," the summons read.
Radman submitted that on September 6, 2017, he and defendants entered into an agreement in which he was to be paid $70 000 for facilitating the acquisition of Shropshire Farm in Gweru, held under deed of transfer number 1782/2015 and registered in favour of Nuconcept Developers.
"The agreement was amended by another agreement dated the January 8, 2018. In terms of the addendum agreement, the amount outstanding as at date was $45 000.
"It was to be paid every monthend with effect from the end of January 2018 in amounts of $10 000, any amount outstanding would attract 10% interests per year," the declaration read.
"The defendants have breached the agreement because no payment has been received, letters have been written requesting for payment to no avail."
Radman prayed for an order compelling the company to pay him his dues in full, plus interest charges and costs of the suit.
