Esidakeni Farm case struck off the roll

The Esidakeni Farm case involving Siphosami Malunga, Zephania Dlamini, Charles Moyo, and the State has been struck off the roll by High Court Judge Justice Bongani Ndlovu, who noted that the case file was disorganized.
Justice Ndlovu directed that the file must be rectified by May 31, 2024. Following this, a new date will be set by the court's Registrar.
Originally scheduled for Friday morning, the case was postponed after Justice Ndlovu found the file to be in disarray.
"The matter is hereby removed from the roll owing to inadequate merging with the following order: Parties are to liaise and come up with one definitive file. The applicants will then upload the definitive file no later than May 31, 2024, on the Integrated Court Management System (ICMS), and the Registrar will then set the matter down in consultation with this court," said Justice Ndlovu.
Minister of Lands, Agriculture, Fisheries, Water, and Rural Development, Dr. Anxious Masuka, is contesting the trio's application to nullify the gazetting of the farm.
Esidakeni Farm was acquired by the Government under the Gazetted Lands (Consequential Provisions) Act in December 2020. It was previously owned by Keshelmar Farms (Pvt) Ltd. Subsequently, 16 beneficiaries were allocated the land in accordance with the Land Commission Act.\
