Kasukuwere says 'Asante sana' after court loss

High Court Justice Tawanda Chitapi's predictable ruling against barred independent presidential candidate Saviour Kasukuwere's urgent application seeking nullification of Statutory Instrument 140A of 2023 which controversially amended the Electoral Act on postal voting effectively endorses the Zimbabwe Electoral Commission (Zec)'s unconstitutional and illegal conduct.

The constitution says once elections have been proclaimed, Zec can't amend the electoral laws.

This is designed to prevent changing of the rules during the course of the game.

Chitapi's ruling further badly discredits the general elections set for 23 August.

The polls are characterised by unconstitutional and illegal actions by Zec and other actors.

In his ruling, Chitapi said: "All said and done, I'm not persuaded that this application  has merit. The application is dismissed with costs."

In reaction, Kasukuwere said:

"If you disagree with a position, you go to court. Courts are not approached with a predetermined outcome. We respect the judgement handed down this afternoon by Hon Chitapi J. The struggle will continue and one day the court of public opinion will decide. Asante Sana. 23 August 2023."
